Abstract

Abstract

This study shows the legal aspects of the impact of the criminal provision on the public employee in the Palestinian law, including the crimes and the criminal penalties, upon which the termination of his service takes place, and the conditions stipulated in the criminal provision. The study also shows the impact of this provision removal on reappointing the public employee.

The study followed the analytical, descriptive method, and used the scientific sources and references to obtain information.

The study reached several results. The most important result is that the Palestinian legislator agrees that if the employee is convicted of a crime or an offence against honor or integrity, his service must be terminated by law.

In addition, the study recommended that it is necessary to amend the text of article (6/96) of Palestinian Civil Service Code No. (4) of 1989, which was amended in Code (4) of 2005, into the form that when the service of the public employee is terminated due to the criminal provision, he should be convicted of a criminal penalty instead of a crime.
